Terms and Conditions – Tip and Tap Application 

Introduction:

These Terms and Conditions constitute a binding legal agreement between the User and Tip and Tap Designing Programs & Applications, the owner of the Tip and Tap smart application, and Xibalba LLC – Xibalba for Designing Programs & Applications, the official developer and operator of the application within the United Arab Emirates.

Tip and Tap is officially licensed by the Telecommunications and Digital Government Regulatory Authority (TDRA) to provide smart application and fintech services.
The application is developed and operated by Xibalba LLC under the same regulatory license issued by TDRA, as both entities belong to the same legal owner and function as a unified operational entity.

Partnership agreements have been signed as follows:
    •    UAE PASS, MyFatoorah, and Network International under the Tip and Tap trade license.
    •    Mawarid Finance agreement for issuing and managing prepaid cards under the Xibalba LLC trade license.

The application operates under the supervision of the UAE Central Bank and the TDRA.
By using the application, the user confirms full and unconditional acceptance of all terms and conditions stated herein.


    1.    Definitions and Interpretation:
• Application: The Tip and Tap platform offering e-payments, money transfers, prepaid cards, and a rewards system.
• Company: Xibalba LLC – Xibalba for Designing Programs & Applications, developer and operator of Tip and Tap.
• Trade Name: Tip and Tap Designing Programs & Applications, licensed by the Dubai Department of Economy and Tourism.
• Authority: Telecommunications and Digital Government Regulatory Authority (TDRA).
• Licensed Financial Partners:
– MyFatoorah: Responsible for wallet top-up, payment links, and management of stored value.
– Network International: Responsible for payment execution and settlement of transactions.
– Mawarid Finance: Sole entity authorized for issuing and managing prepaid cards for users.
• User: Any natural person creating an account and using the application.
• Applicable Laws: All federal and local laws of the United Arab Emirates and related regulations.


    2.    Terms of Use:
• The User must use the application in compliance with UAE laws and regulations.
• Any illegal use, including money laundering, terrorism financing, or corruption, is strictly prohibited.
• The application is not available in jurisdictions classified as “high-risk” by the Financial Action Task Force (FATF).


    3.    Registration and Verification (KYC / UAE PASS):
• Registration requires accurate and up-to-date information.
• Verification may occur through UAE PASS and compliance with Know Your Customer (KYC) and Anti-Money Laundering / Counter-Terrorism Financing (AML/CFT) policies.
• The Company reserves the right to suspend or terminate any account that fails verification or is involved in suspicious activity.


    4.    Scope of Services:
• Wallet top-up and stored-value management.
• Peer-to-peer micro-transfers between users.
• Secure payment links for digital transactions.
• Issuing and managing prepaid cards in collaboration with Mawarid Finance.
• Points accumulation and redemption within the application.


    5.    Regulatory Compliance:
• The application operates under the direct supervision of TDRA and complies with the UAE Central Bank’s regulatory framework.
• All financial operations are performed exclusively through licensed financial partners.


    6.    Financial Limits and Fees:
• Maximum wallet balance: AED 10,000.
• Payment link limits: Minimum AED 5 – Maximum AED 3,000 per transaction.
• Transfer fee: AED 23 per transaction (subject to prior notice of change).
• Withdrawal processing time:
– Minimum 12 business hours and maximum 7 business days from the request date.
– Duration depends on bank or exchange-house policies; delays beyond this are outside the Company’s control.
• The User is responsible for ensuring the accuracy of bank or exchange details; incorrect data may cause delays or rejections.


    7.    Rewards and Points System:
• Every 1,000 points = 1 USD.
• Points may be redeemed in cash or used within the application.
• Points are not bank deposits and do not accrue interest.
• The Company may modify redemption rules with prior notice.


    8.    Data Protection and Sharing:
• Personal data are collected and processed using advanced encryption (SSL).
• Data are shared only with authorized partners (MyFatoorah, Network International, Mawarid Finance) when necessary for transactions or card issuance.
• The application is directly integrated with UAE PASS for secure identity verification.
• No user data are used for advertising without explicit consent.


    9.    Anti-Money Laundering and Counter-Terrorism Financing:
• The Company and its partners adhere to UAE and international AML/CFT regulations.
• Transactions suspected of illegal activity may be frozen and reported to the authorities.


    10.    Wallet Security and Prepaid-Card Management:
• Wallet stored value is managed by MyFatoorah under UAE Central Bank standards.
• Payment and settlement services are provided through MyFatoorah and Network International.
• All prepaid-card operations—issuance, activation, suspension, cancellation, verification, and settlement—are handled exclusively by Mawarid Finance, licensed by the UAE Central Bank.
• Xibalba LLC and Tip and Tap bear no legal or financial liability for delays, disputes, or errors related to prepaid-card services.
• Use of the prepaid card is subject to Mawarid Finance’s own Terms and Conditions.


    11.    Refund Policy:
• Refunds apply only in cases of technical errors or duplicate charges.
• Requests must be submitted within 10 days of the transaction with supporting documents.
• Approved refunds will be processed within 30 business days.
• Refunds are not provided for fully used services or user errors.


    12.    Force Majeure:
• The Company and its partners are not liable for delays or failures caused by uncontrollable events, including natural disasters, wars, government actions, or system outages.


    13.    Intellectual Property:
• All logos, trademarks, designs, codes, and content are the exclusive property of Tip and Tap Designing Programs & Applications.
• Any unauthorized use, copying, or distribution is strictly prohibited.


    14.    Limitation of Liability:
• The application is provided “as is” without warranties of any kind.
• The Company and partners are not liable for direct or indirect damages arising from the use or inability to use the application, except in cases of fraud or gross negligence.


    15.    Amendments:
• The Company may modify these Terms, fees, or operational limits when necessary.
• Users will be notified of any material change at least 30 days before it becomes effective.


    16.    Minimum Age:
• The application is available only to users aged 18 years and above.
• Verification of age may be required through UAE PASS.


    17.    Jurisdiction and Arbitration:
• These Terms are governed by the laws of the United Arab Emirates.
• All disputes shall be resolved through arbitration under the Dubai International Arbitration Centre (DIAC) Rules.
• The seat of arbitration shall be Dubai, the language Arabic, and the arbitral award shall be final and binding on both parties.


    18.    Acknowledgment and Consent:
• The User acknowledges having read, understood, and agreed to all provisions of these Terms and Conditions.
• Creating an account or continuing to use the application constitutes explicit and binding consent to these Terms.
• By clicking “I Agree” within the application, the User provides legally valid electronic consent equivalent to a digital signature under the UAE Electronic Transactions and Commerce Law.


    19.    Final Provisions:
• Using the application constitutes full acceptance of these Terms.
• This document is prepared in accordance with the laws of the United Arab Emirates.
• Users may contact the support team through official channels within the application for any inquiries or complaints.
